These Terms of Service (“Terms”) govern your access to and use of the Amilu mobile application, any related websites, organizer features, communication features, and all associated services, functions, content, and tools (collectively, the “App”, “Platform”, or “Service”). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not create an account or use the Service. Your use of the Service is also subject to our Privacy Policy, which forms an integral part of these Terms. The Service is operated by Zypheris GmbH, c/o BlueAUDIT GmbH, Schindellegistrasse 73, 8808 Pfäffikon, Switzerland, hello@amilu.app (“Amilu”, “we”, “us”, “our”). Amilu is a trademark of Zypheris GmbH. We may amend these Terms of Service from time to time. If we make material changes, we will notify you through the App or by other reasonable means. Continued use of the Service after such notice constitutes acceptance of the updated Terms, unless mandatory law requires a different form of consent.
Amilu is a technology platform that enables users to discover, create, and join spontaneous social activities and events with other users. Amilu acts solely as a neutral technical intermediary and provider of digital platform services. Amilu does not organize, host, manage, supervise, direct, control, or participate in activities created by users. Amilu is not an event organizer, co-organizer, host, promoter, venue operator, childcare service, security provider, travel organizer, ticket seller, reseller, or payment processor, unless explicitly stated otherwise in a separate agreement. Amilu is not a party to any arrangement, agreement, understanding, or relationship between users. All activities are created, organized, joined, and attended solely at the discretion, initiative, and responsibility of the participating users. Amilu does not generally verify the identity, background, criminal record, character, reliability, or suitability of any user. Any information shown on a profile or activity listing is generally self-reported and has not been independently verified, endorsed, or guaranteed by Amilu. Amilu makes no representations, warranties, or guarantees regarding the conduct, intentions, reliability, or trustworthiness of any user.
We are entitled to modify, update, enhance, restrict, suspend, discontinue, or terminate the Service, or any part, feature, or functionality thereof, at any time, temporarily or permanently, with or without notice, to the extent permitted by law. We do not guarantee that the Service will be available at all times, without interruption, in all locations, or on all devices. The Service may be subject to interruptions, delays, maintenance windows, technical errors, bugs, inaccuracies, latency, or other limitations. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE ARE NOT LIABLE FOR ANY SUCH INTERRUPTIONS, DELAYS, ERRORS, LOSSES OF AVAILABILITY, OR TECHNICAL LIMITATIONS, UNLESS CAUSED BY OUR INTENTIONAL MISCONDUCT OR GROSS NEGLIGENCE.
You are not authorized to create an account or use the Service unless all of the following are true: you are at least 18 years old; you are legally capable of entering into a binding contract; you are not prohibited by law from using the Service; you do not maintain more than one personal account on the Service unless expressly permitted by us; and you have not previously been removed or banned from the Service by us. By creating an account, you confirm that you are at least 18 years old. Amilu may rely on the information provided by you during registration. Amilu does not generally perform identity checks or age verification through official ID documents unless we explicitly decide to do so in individual cases. If you provide false or misleading information regarding your age or identity, you are in breach of these Terms and your authorization to use the Service may be revoked immediately. For the avoidance of doubt, minors do not hold accounts on Amilu. Section 8 applies only where children physically accompany their parents or legal guardians to activities arranged through the Platform.
You are responsible for maintaining the confidentiality and security of your login credentials and for all activity that occurs under your account. You must provide accurate, complete, and truthful information during registration and keep your profile up to date. You must notify us immediately at hello@amilu.app if you suspect unauthorized access to your account or any unauthorized use of your credentials. You may not use another user's account, share your account credentials, allow third parties to access your account, or transfer your account to another person. We may suspend, restrict, or terminate accounts that are used in violation of these Terms, that are suspected of abusive, deceptive, unlawful, or unsafe behavior, or that otherwise pose risks to users, to us, or to the integrity of the Service.
You agree to use Amilu respectfully, safely, and in compliance with all applicable laws. The following conduct is strictly prohibited: • Creating fake profiles, impersonating others, or misleading users regarding your identity, age, intentions, or background • Harassing, threatening, bullying, stalking, doxxing, intimidating, or sexually harassing other users • Posting or sharing illegal, offensive, discriminatory, hateful, extremist, violent, sexually explicit, exploitative, or otherwise impermissible content • Using the Platform for fraud, scams, phishing, deceptive conduct, pyramid schemes, or other abusive purposes • Commercial solicitation, advertising, spam, or direct marketing outside expressly permitted organizer features • Collecting, storing, exporting, or using personal data of other users for purposes outside the intended use of the Platform • Promoting illegal activities • Circumventing or interfering with the security, moderation, or operation of the Service • Creating activities with the intent to deceive, scam, radicalize, recruit, or harm users • Using bots, automated systems, scrapers, or malware • Reverse engineering, decompiling, or disassembling any part of the Service Amilu is intended as a neutral platform for social connection. Activities with a political or religious context may be permitted if they are non-discriminatory, inclusive, lawful, and not used for recruitment, radicalization, incitement, or hate. WE MAY SUSPEND OR PERMANENTLY DELETE ACCOUNTS, RESTRICT FEATURES, REMOVE CONTENT, REDUCE VISIBILITY, OR TAKE OTHER ACTION AGAINST USERS WHO VIOLATE THESE RULES, WITHOUT PRIOR NOTICE WHERE LEGALLY PERMITTED.
AMILU PROVIDES TECHNOLOGY THAT ALLOWS USERS TO DISCOVER AND CONNECT WITH ONE ANOTHER. AMILU DOES NOT VET, SUPERVISE, ENDORSE, OR GUARANTEE ANY USER, ACTIVITY, EVENT, MEETING, OR ORGANIZER. BY USING THE SERVICE, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT PARTICIPATION IN ANY ACTIVITY OR EVENT ARRANGED THROUGH AMILU IS ENTIRELY AT YOUR OWN RISK. YOU VOLUNTARILY ASSUME ALL RISK OF PERSONAL INJURY, ILLNESS, EMOTIONAL DISTRESS, PROPERTY DAMAGE, FINANCIAL LOSS, REPUTATIONAL HARM, OR ANY OTHER LOSS OR DAMAGE THAT MAY RESULT FROM YOUR INTERACTIONS WITH OTHER USERS, WHETHER ONLINE OR OFFLINE. AMILU HAS NO CONTROL OVER AND ACCEPTS NO RESPONSIBILITY FOR THE IDENTITY, CONDUCT, INTENTIONS, STATEMENTS, OMISSIONS, OR BEHAVIOR OF ANY USER. THIS INCLUDES INTERACTIONS BEFORE, DURING, OR AFTER MEETINGS, ACTIVITIES, EVENTS, OR CHATS ARRANGED THROUGH THE SERVICE. We strongly recommend that you meet in public places, inform a friend or family member of your plans, avoid sharing sensitive personal information too early, trust your instincts, and leave any situation that makes you uncomfortable. Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by our intentional misconduct or gross negligence, fraud, or any liability that mandatory law does not permit us to exclude or limit.
Some activities on Amilu may be designated for families or children. In all such cases, parents and legal guardians bear full, sole, and non-transferable responsibility for the supervision, safety, transport, wellbeing, and care of their children at all times. CHILDREN MUST NOT BE LEFT UNSUPERVISED AND MUST NOT BE PLACED IN THE CARE, CUSTODY, OR SUPERVISION OF OTHER USERS UNLESS THIS OCCURS ENTIRELY OUTSIDE THE PLATFORM AND UNDER THE SOLE RESPONSIBILITY OF THE PARENTS OR LEGAL GUARDIANS CONCERNED. AMILU IS NOT A CHILDCARE SERVICE, BABYSITTING SERVICE, OR SUPERVISION SERVICE. Parents and legal guardians are solely responsible for assessing whether a particular activity, venue, host, organizer, or participant is appropriate and safe for their children before attending. AMILU DOES NOT VERIFY THE SUITABILITY OF ANY USER, ORGANIZER, OR EVENT FOR MINORS AND, TO THE MAXIMUM EXTENT PERMITTED BY LAW, DISCLAIMS LIABILITY FOR HARM INVOLVING MINORS ARISING FROM ACTIVITIES ARRANGED THROUGH THE PLATFORM, EXCEPT WHERE LIABILITY CANNOT LAWFULLY BE EXCLUDED.
You are solely responsible for any content you post, upload, send, or otherwise make available through Amilu, including photos, text, messages, activity descriptions, comments, and profile information. By posting content, you grant Amilu a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to use, display, reproduce, store, adapt, modify, publish, distribute, and process such content solely for the purpose of operating, providing, improving, promoting, securing, and legally complying in relation to the Service. You represent and warrant that you have all necessary rights to the content you post and that your content does not violate the rights of any third party or applicable law. We may remove, restrict, block, edit, or reduce the visibility of any content where we consider it unlawful, unsafe, misleading, abusive, or contrary to these Terms. We are not obliged to monitor all content proactively, subject to any applicable legal obligations.
If you encounter inappropriate, unlawful, unsafe, or abusive behavior, you may report users, content, chats, or activities directly through the App where such functionality is provided. You may also block users through the available account tools. We may review reports and may take action including warnings, content removal, feature restrictions, temporary suspension, permanent account deletion, or referral to competent authorities, where legally appropriate. REPORTING DOES NOT GUARANTEE A SPECIFIC OUTCOME. WE REVIEW REPORTS IN ACCORDANCE WITH OUR INTERNAL PROCESSES AND LEGAL OBLIGATIONS, AND WE ARE NOT OBLIGED TO TAKE A PARTICULAR ACTION IN EVERY CASE OR TO DISCLOSE THE OUTCOME OF ANY INVESTIGATION, EXCEPT WHERE REQUIRED BY LAW. We may use automated tools and human review as part of our moderation and trust & safety processes. Automated moderation is only one part of our safety framework and does not guarantee that all impermissible content or conduct will be detected or prevented. If you believe that a moderation decision was made in error, you may submit an appeal by contacting us at hello@amilu.app. We will review your appeal and notify you of the outcome.
Amilu may offer paid subscription features or other paid digital services. By purchasing a subscription, you agree to pay the applicable fees as described at the time of purchase. Subscriptions may automatically renew unless cancelled before the end of the current billing period. If your subscription is purchased via Apple App Store or Google Play Store, renewal, cancellation, billing, and refunds are governed by the rules and interfaces of the respective app store provider. Refunds are handled in accordance with the applicable app store policies or mandatory law. Amilu does not generally provide direct refunds outside those rules, unless mandatory law requires otherwise. We reserve the right to change subscription pricing at any time. Price changes will take effect no earlier than the start of your next billing period after notice.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. AMILU DOES NOT WARRANT, REPRESENT, OR GUARANTEE THE ACCURACY, RELIABILITY, COMPLETENESS, LEGALITY, OR TRUTHFULNESS OF USER PROFILES, EVENT LISTINGS, ORGANIZER INFORMATION, OR ANY OTHER INFORMATION MADE AVAILABLE THROUGH THE SERVICE. AMILU DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, ACCURATE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR ITS INFRASTRUCTURE ARE FREE FROM HARMFUL COMPONENTS. No oral or written information or advice given by Amilu creates any warranty unless explicitly confirmed in writing by an authorized representative of Zypheris GmbH. Nothing in this Section excludes any rights that cannot be waived or any warranties that cannot be excluded under mandatory law.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AMILU SHALL NOT BE LIABLE FOR ANY LOSS, DAMAGE, INJURY, CLAIM, COST, OR LIABILITY ARISING OUT OF OR IN CONNECTION WITH INTERACTIONS BETWEEN USERS, ACTIVITIES OR EVENTS ARRANGED THROUGH THE SERVICE, CONDUCT OF USERS OR ORGANIZERS, USER-GENERATED CONTENT, UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA, SERVICE INTERRUPTIONS, TECHNICAL FAILURES, BUGS, OR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR PURELY ECONOMIC DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITIES, GOODWILL, OR REPUTATION. AMILU SHALL IN PARTICULAR NOT BE LIABLE FOR CONDUCT, OMISSIONS, STATEMENTS, OR ACTS OF USERS, ORGANIZERS, VENUES, EXTERNAL TICKET PROVIDERS, OR ANY OTHER THIRD PARTIES, WHETHER ONLINE OR OFFLINE. IN NO EVENT SHALL AMILU’S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED THE AMOUNT ACTUALLY PAID BY YOU TO AMILU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR, IF NO PAYMENT WAS MADE, A REASONABLE AMOUNT CORRESPONDING TO THE FORESEEABLE TYPICAL DAMAGE, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY INTENTIONAL MISCONDUCT OR GROSS NEGLIGENCE, FRAUD, OR ANY LIABILITY THAT CANNOT BE EXCLUDED UNDER MANDATORY LAW.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU ACKNOWLEDGE THAT AMILU IS ONLY A NEUTRAL PLATFORM PROVIDER AND THAT YOUR USE OF THE SERVICE, PARTICIPATION IN ACTIVITIES, ATTENDANCE AT EVENTS, AND INTERACTIONS WITH OTHER USERS TAKE PLACE PRIMARILY AT YOUR OWN RISK AND RESPONSIBILITY. FOR THE AVOIDANCE OF DOUBT, NOTHING IN THESE TERMS SHALL BE INTERPRETED AS EXCLUDING OR WAIVING CLAIMS THAT CANNOT LAWFULLY BE EXCLUDED OR WAIVED UNDER APPLICABLE MANDATORY LAW.
You agree to indemnify and hold harmless Amilu, Zypheris GmbH, its directors, officers, employees, agents, affiliates, successors, and assigns from and against claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising out of or in connection with your use of or access to the Service, your violation of these Terms or applicable law, your violation of third-party rights, any activity you create, join, or participate in, any content you post or share, your interactions with other users, or any harm caused to a minor under your supervision during an activity, to the extent such indemnification is permitted under applicable law. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, at your expense where permitted by law.
The Service may contain links to or integrations with third-party websites, services, ticket providers, maps, payment services, or content not owned or controlled by Amilu. We do not control and are not responsible for the content, legality, availability, privacy policies, accuracy, or security of third-party services. Your use of such services is entirely at your own risk and subject to the terms of those third parties. AMILU SHALL NOT BE LIABLE FOR ANY DAMAGE OR LOSS CAUSED BY OR IN CONNECTION WITH YOUR USE OF ANY THIRD-PARTY SERVICES, TICKET LINKS, OR EXTERNAL WEBSITES, EXCEPT TO THE EXTENT LIABILITY CANNOT LAWFULLY BE EXCLUDED.
The Amilu name, logo, design, software, user interface, features, and underlying technology are the exclusive property of Zypheris GmbH or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, license, reverse engineer, decompile, disassemble, or create derivative works based on our intellectual property without our express written consent, except where mandatory law allows otherwise. By submitting feedback, suggestions, or ideas to Amilu, you grant us an unrestricted, worldwide, irrevocable, perpetual, royalty-free right to use such feedback for any purpose without compensation, acknowledgement, or attribution.
You may delete your account at any time through the available settings or by contacting us where necessary. Deleting your account does not automatically entitle you to a refund for paid services unless mandatory law or applicable app store rules require otherwise. We may suspend, restrict, or terminate your account at any time, at our sole discretion, for legitimate reasons, including violation of these Terms, suspected fraudulent, harmful, illegal, or unsafe activity, conduct on or off the Platform that we reasonably consider harmful to users or to the integrity of the Service, or any other objectively justified reason. Upon termination initiated by Amilu without cause and where a prepaid subscription remains unused, we may provide a pro rata refund where required by mandatory law or applicable app store rules. Rights and obligations that by their nature should survive termination shall survive termination.
We may update these Terms at any time. We will notify you of material changes through the App or by other reasonable means. Your continued use of Amilu after such notification constitutes acceptance of the updated Terms, unless mandatory law requires your affirmative consent. If you do not agree to the changes, you must stop using the App and delete your account.
Any dispute arising from or relating to these Terms or the Service should first, where reasonably possible, be addressed through good-faith communication between the parties. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE MUST BE COMMENCED WITHIN ONE YEAR AFTER THE CAUSE OF ACTION ACCRUED. THIS LIMITATION DOES NOT APPLY WHERE MANDATORY LAW PROVIDES FOR A LONGER PERIOD OR PROHIBITS SUCH LIMITATION. Any requirement to pursue claims individually and not in collective or representative proceedings applies only to the extent permitted by applicable law.
Amilu shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including natural disasters, pandemics, epidemics, war, terrorism, riots, civil unrest, government action, sanctions, embargoes, power failures, internet or telecommunications failures, cyberattacks, or failures of third-party service providers.
By creating an account, you consent to receive electronic communications from Amilu, including push notifications, in-app messages, and emails, insofar as these are necessary for the operation of the Service, account security, legal notices, or consented communications. You agree that agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirement that such communications be in writing, to the extent permitted by applicable law.
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect. These Terms, together with the Privacy Policy and any additional feature-specific terms, constitute the entire agreement between you and Amilu regarding the Service and supersede all prior or contemporaneous agreements, representations, and understandings, whether written or oral. Our failure to exercise or enforce any right or provision shall not constitute a waiver of such right or provision.
These Terms are governed by and construed in accordance with Swiss law, without regard to its conflict of law provisions. Where you are a consumer, mandatory consumer protection provisions of the country of your habitual residence remain reserved. Likewise, mandatory consumer jurisdiction rules remain reserved. Any disputes arising from or in connection with these Terms shall, to the extent permitted by law, be subject to the jurisdiction of the courts at the registered seat of Zypheris GmbH. Consumers in Switzerland may also rely on mandatory Swiss consumer jurisdiction rules. Consumers in the EU may retain the benefit of mandatory jurisdiction and consumer protection rules applicable in their country of residence.

These Organizer Terms apply to any user who creates or uses an Organizer Account or organizer functionality on the Platform. These Organizer Terms supplement, and do not replace, the User Terms of Service and the Privacy Policy.
By creating or using an Organizer Account, you confirm that you have read, understood, and agree to be bound by these Organizer Terms in addition to the User Terms of Service. We may amend these Organizer Terms from time to time. Material changes will be communicated through the App or by other reasonable means.
AMILU IS A NEUTRAL TECHNOLOGY PLATFORM THAT ALLOWS ORGANIZERS TO LIST EVENTS AND ALLOWS USERS TO DISCOVER SUCH EVENTS. AMILU IS NOT AN EVENT ORGANIZER, CO-ORGANIZER, PROMOTER, PRODUCER, VENUE OPERATOR, TICKET SELLER, TICKET RESELLER, PAYMENT PROCESSOR, OR PARTY TO ANY TRANSACTION OR ARRANGEMENT BETWEEN AN ORGANIZER AND ANY ATTENDEE, VENUE, VENDOR, OR THIRD PARTY. Amilu does not participate in, supervise, direct, control, or manage any aspect of an event listed on the Platform. The relationship between an Organizer and any attendee exists solely between those parties.
As an Organizer, you are solely and fully responsible for the planning, organization, promotion, execution, and management of every event you list; the accuracy and completeness of all event information; the safety, security, legality, and suitability of the event and venue; required staffing, supervision, capacity management, permits, licenses, insurance, tax compliance, and communications with attendees; and any disputes, complaints, cancellations, refunds, injuries, losses, or claims arising out of the event. YOU ACKNOWLEDGE THAT AMILU HAS NO INVOLVEMENT IN AND ACCEPTS NO RESPONSIBILITY FOR ANY ASPECT OF YOUR EVENT BEYOND PROVIDING TECHNICAL PLATFORM FUNCTIONALITY.
All event information you provide must be accurate, complete, lawful, truthful, and not misleading. This includes titles, descriptions, dates, times, locations, venues, pricing, age restrictions, capacity, and special conditions. You must not post false, deceptive, or fraudulent event listings, misrepresent the nature or quality of an event, promise performers or services you cannot reasonably secure, use organizer features for scams or data harvesting, or create events for unrelated solicitation or recruitment purposes. Amilu does not generally pre-approve or fact-check event listings before publication. We may remove, restrict, modify, or reduce the visibility of any event listing at any time where we consider this necessary for legal, safety, integrity, or operational reasons.
THE “MANAGE SPOTS” FEATURE IS PROVIDED SOLELY AS A CONVENIENCE FEATURE TO DISPLAY A NUMBER OF PLACES OR ATTENDANCE SIGNALS WITHIN THE APP. IT IS NOT A BOOKING SYSTEM, RESERVATION SYSTEM, OR TICKETING SYSTEM. TAPPING “GOING” DOES NOT CONSTITUTE A TICKET PURCHASE, BINDING RESERVATION, CONTRACTUAL RIGHT OF ADMISSION, OR GUARANTEE OF ENTRY. AMILU DOES NOT GUARANTEE THAT THE DISPLAYED SPOT COUNT MATCHES ACTUAL VENUE CAPACITY, TICKET SALES, GUEST LISTS, DOOR SALES, OR ANY OTHER EXTERNAL CHANNEL. THE ORGANIZER IS SOLELY RESPONSIBLE FOR MANAGING TOTAL CAPACITY ACROSS ALL CHANNELS AND FOR MANUALLY RECONCILING ANY DISCREPANCIES. AMILU ACCEPTS NO LIABILITY FOR OVERBOOKING, DENIED ENTRY, OVERCROWDING, OR ANY CLAIMS ARISING FROM CAPACITY DISCREPANCIES, EXCEPT WHERE LIABILITY CANNOT LAWFULLY BE EXCLUDED.
Organizers may add links to external websites where users can purchase tickets or obtain further information. AMILU IS NOT A TICKET SELLER, TICKET BROKER, TICKET RESELLER, PAYMENT PROCESSOR, OR CONTRACTUAL PARTY TO ANY EXTERNAL TICKET TRANSACTION. ANY PURCHASE, RESERVATION, REFUND, BOOKING, OR DISPUTE OCCURRING ON OR THROUGH AN EXTERNAL WEBSITE EXISTS SOLELY BETWEEN THE USER, THE ORGANIZER, AND/OR THE THIRD-PARTY TICKET PROVIDER. THE ORGANIZER IS SOLELY RESPONSIBLE FOR THE LEGITIMACY, SAFETY, LAWFULNESS, AND ACCURACY OF ALL LINKS, URLS, AND EXTERNAL TICKET SALES CHANNELS THEY POST ON THE PLATFORM. IF A LINK LEADS TO FRAUDULENT, MALICIOUS, MISLEADING, OR UNLAWFUL CONTENT, THE ORGANIZER BEARS SOLE RESPONSIBILITY. Amilu may implement basic technical or automated checks on links, but such checks are provided on a best-effort basis and do not constitute any guarantee of safety or legitimacy.
The Organizer is solely responsible for complying with all laws, regulations, permits, approvals, licenses, taxes, safety requirements, youth protection rules, alcohol or food regulations, copyright licenses, data protection rules, accessibility requirements, anti-discrimination rules, venue requirements, and any other legal obligations relevant to the event. Amilu does not verify or enforce such compliance and accepts no responsibility for fines, penalties, legal proceedings, or damages arising from an Organizer's non-compliance.
If an Organizer creates an event designated for families or children, the Organizer must ensure that the event environment is reasonably safe and age-appropriate, clearly communicate supervision requirements and restrictions, and comply with applicable child protection and youth welfare rules. AMILU DOES NOT VERIFY THE SUITABILITY OF ANY ORGANIZER, ATTENDEE, OR EVENT FOR MINORS AND DISCLAIMS LIABILITY, TO THE EXTENT PERMITTED BY LAW, FOR HARM INVOLVING MINORS AT EVENTS LISTED ON THE PLATFORM.
If an Organizer cancels, postpones, relocates, or materially changes an event, the Organizer must notify attendees as promptly as possible, update the event listing, and handle any associated attendee communication, refunds, or legal obligations directly. Amilu may provide technical communication tools but does not guarantee that notifications will be delivered, received, or read in time.
Organizers may only use attendee information made available through the Platform for the limited purpose of managing the specific event concerned. Organizers must not store, export, copy, retain, share, sell, profile, license, market to, or otherwise use attendee information outside the specific event purpose unless they have an independent legal basis and have complied with all applicable data protection laws. Unauthorized use of attendee information may result in immediate suspension or deletion of the Organizer Account.
By posting event listings, images, descriptions, and other content through an Organizer Account, you grant Amilu a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to use, display, reproduce, adapt, modify, publish, and distribute such content for the purpose of operating, promoting, securing, improving, and archiving the Service. You represent and warrant that you have all rights necessary for such use and that your content does not infringe third-party rights.
Creating an Organizer Account and listing events may currently be free of charge unless otherwise indicated. We reserve the right to introduce fees, subscriptions, paid features, commissions, or premium organizer plans at any time with prior notice. Unless expressly stated otherwise, Amilu does not collect event revenue on behalf of Organizers, does not hold funds in escrow, and does not process refunds for organizer-run external sales. The Organizer remains solely responsible for all taxes, fees, payment obligations, and financial consequences relating to their events and revenues.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ORGANIZER FEATURES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. AMILU MAKES NO GUARANTEE REGARDING EVENT REACH, DISCOVERABILITY, VISIBILITY, ATTENDANCE, TICKET SALES, CONVERSION, REVENUE, ANALYTICS, ENGAGEMENT, NOTIFICATION DELIVERY, OR THE CORRECT FUNCTIONING OF ANY SPECIFIC ORGANIZER FEATURE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AMILU SHALL NOT BE LIABLE FOR INJURY, HARM, DEATH, DAMAGE, OR LOSS ARISING FROM OR IN CONNECTION WITH ANY EVENT LISTED, ORGANIZED, PROMOTED, HOSTED, OR LINKED THROUGH THE PLATFORM; CONDUCT OF ATTENDEES, VENDORS, VENUES, CONTRACTORS, OR THIRD PARTIES; TICKET DISPUTES OR REFUND DISPUTES; FOOD, BEVERAGES, VENUE CONDITIONS, SAFETY ISSUES, CAPACITY ISSUES, CANCELLATIONS, NO-SHOWS, SCHEDULE CHANGES, MISREPRESENTED EVENTS, EXTERNAL WEBSITES, TICKET LINKS, OR ORGANIZER MISUSE OF ATTENDEE DATA. IN NO EVENT SHALL AMILU’S TOTAL AGGREGATE LIABILITY TO ANY ORGANIZER FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE ORGANIZER TERMS OR THE SERVICE EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY THE ORGANIZER TO AMILU DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. NOTHING IN THESE ORGANIZER TERMS EXCLUDES LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED.
THE ORGANIZER AGREES, TO THE EXTENT PERMITTED BY LAW, TO INDEMNIFY AND HOLD HARMLESS AMILU, ZYPHERIS GMBH, AND ITS RELATED PERSONS FROM AND AGAINST CLAIMS, LOSSES, LIABILITIES, DAMAGES, COSTS, AND EXPENSES ARISING OUT OF OR IN CONNECTION WITH ANY EVENT CREATED, LISTED, PROMOTED, ORGANIZED, OR HOSTED BY THE ORGANIZER, ANY INJURY OR LOSS IN CONNECTION WITH THE EVENT, ANY ATTENDEE OR THIRD-PARTY CLAIM, ANY LEGAL NON-COMPLIANCE, ANY MISREPRESENTATION IN THE EVENT LISTING, ANY UNLAWFUL HANDLING OF ATTENDEE DATA, ANY EXTERNAL LINK OR URL POSTED BY THE ORGANIZER, OR ANY VIOLATION OF THESE TERMS.
Amilu may suspend, restrict, or permanently delete an Organizer Account and/or remove one or more event listings at any time for legitimate reasons, including complaints, reports, legal or safety concerns, suspected fraud, inactivity, misleading listings, reputational risks, or any violation of these Organizer Terms or the User Terms. The Organizer may deactivate the Organizer Account at any time, but remains solely responsible for any events already scheduled, listed, or promoted.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE ORGANIZER ACKNOWLEDGES THAT AMILU ONLY PROVIDES A NEUTRAL TECHNICAL PLATFORM AND DOES NOT GUARANTEE THE PERFORMANCE, REACH, COMMERCIAL SUCCESS, OR SAFETY OUTCOME OF ANY EVENT LISTING OR ORGANIZER FEATURE. NOTHING IN THESE ORGANIZER TERMS SHALL BE INTERPRETED AS EXCLUDING OR WAIVING CLAIMS THAT CANNOT LAWFULLY BE EXCLUDED OR WAIVED UNDER MANDATORY LAW.
Amilu shall not be liable for any failure or delay in performing its obligations under these Organizer Terms where such failure or delay results from circumstances beyond our reasonable control, including natural disasters, pandemics, war, riots, government action, sanctions, cyberattacks, telecommunications failures, or failures of third-party providers.
If any provision of these Organizer Terms is invalid or unenforceable, the remaining provisions shall remain in full force and effect. These Organizer Terms, together with the User Terms and Privacy Policy, form the entire agreement between Amilu and the Organizer concerning organizer use of the Platform.
These Organizer Terms are governed by Swiss law, without regard to its conflict of law provisions. Where the Organizer qualifies as a consumer under applicable law, mandatory consumer protections and jurisdiction rules remain reserved. Otherwise, the exclusive place of jurisdiction shall, to the extent permitted by law, be the registered seat of Zypheris GmbH in Switzerland.
